Jury Duty and Breastfeeding
In Montana a mother of a toddler was called to jury duty. Her sister was supposed to come and take care of the boy but for some reason, didn't show up. So like any smart and good mother, she brought the baby to the courthouse. Afterall, she had to feed her child, not to mention not leaving the child home alone! When she asked to be deferred, the judge denied her. And to boot, she was charged with contempt of court (apparently her son was a little loud and disruptive) and a suspended sentence of 24 hours in jail! I was reading this and it made me wonder if there's a law concerning breastfeeding moms and jury duty.
As it turns out, there's no federal law but, according to La Leche League, 11 states have various laws on the books directly addressing breastfeeding and jury duty. They are: Idaho, Kansas, Oregon, Nebraska, Oklahoma, Illinois, Virginia, Iowa, Mississippi, Kentucky and California.
There are other states that exempt a nursing mom from jury duty under something called Family Friendly Jury Duty legislation. This legislation varies in scope, but allows parents who are primary caretakers of a child or an elderly or disabled relative, to be excused or deferred. This is normally enough to cover breastfeeding.
But there's confusion out there. It's evident from reading posts on message boards etc. It seems to me a federal law would clear it all up. Am I missing something?
